GENERAL TERMS AND CONDITIONS

Article 1 – General
With regard to the general terms and conditions of sale, the following definitions apply:

  1. Seller: LES SOEURS SRL
  2. Customer/buyer: the natural person who purchases one or more product(s) through the seller's webshop.
  3. Order: any offer, quotation, order, delivery of goods and services and/or invoice.

Article 2 – Application
The general terms and conditions apply to all contracts concluded by LES SOEURS. They take precedence over any written or printed terms and conditions of the buyer. By placing an order on the LES SOEURS website, the buyer declares that he accepts the present terms and conditions. Deviations or additions are valid only if accepted in writing by LES SOEURS. These general terms and conditions form an integral part of the agreement and govern the legal relationship between the parties. These general terms and conditions are made available to the customer. They shall be deemed to be expressly and irrevocably accepted when visiting the website, ordering on the webshop, the customer's signing or confirmation of an order form, quotation or agreement, payment of an invoice irrespective of previous correspondence, and shall take precedence over any other terms and conditions of any kind on the part of the customer. The invalidity of any provision of these general terms and conditions does not affect the validity or enforceability of the other provisions.

Article 3 – Offer
LES SOEURS' offer consists of clothing, jewellery, accessories, lifestyle products, ... and related services. If an offer has a limited validity or is subject to conditions, this will be expressly stated in the offer. The offer contains a complete and accurate description of the product, digital content and/or services. The description is detailed enough to enable consumers to form an accurate and detailed picture of the offer. Any images used are a faithful representation of the products and/or digital content on offer. Obvious mistakes or errors in the offer do not bind LES SOEURS. Each offer contains the information necessary to make clear to consumers the rights and obligations attached to acceptance of the offer.

Article 4 – Orders
Orders may be initiated through various channels, but ultimately result in an order being placed on the LES SOEURS website. The buyer will receive an e-mail confirming and summarising the order. All offers issued by LES SOEURS are non-binding and only become binding when the order is confirmed and the order confirmation is provided.

Article 5 – Price and payment
The prices of products and services are listed on the website and guaranteed by LES SOEURS, except in cases of force majeure. Prices are in euros and include 21% VAT. Any delivery costs are not included. Discount codes or promotions, unless otherwise expressly defined, can only be used once per customer and therefore per account and, unless otherwise expressly defined, cannot be combined with other promotions, do not apply to orders already placed and cannot be redeemed for cash.

Payments are online. Online payments are secure and take place on an external secure server of a specialised online payment partner. The buyer is not authorised to reduce the purchase price by any amount of any counterclaim against LES SOEURS. LES SOEURS has the right to change certain prices, including shipping costs, at any time, regardless of the motive, although there is a commitment to apply the published prices at the time of purchase by the customer.

Article 6 – Delivery and execution
LES SOEURS charges a delivery fee for all deliveries. The cost is calculated during the checkout process and is based on the products ordered and the delivery address provided by the buyer. Although most products are available from stock, the indicated delivery time is not binding. Delays in delivery can never give rise to compensation or dissolution of the contract or suspension of any obligations of the buyer towards LES SOEURS. In the event of force majeure, LES SOEURS shall have the option to cancel the agreement without court intervention or to suspend the delivery time until the force majeure no longer exists, without the buyer being entitled to compensation. If a buyer fails to fulfil his obligations to LES SOEURS, LES SOEURS shall be entitled to suspend further deliveries and/or services. The place of delivery shall be the address communicated by the consumer to LES SOEURS.

Article 7 – Right of withdrawal
In accordance with Article 47 e.f. of Book VI of the Economic Code and Consumer Information and Protection Code, the buyer has a right of withdrawal. All non-personalised items may be returned by the buyer without giving reasons within 30 days of receiving the order. The return and shipping instructions provided by LES SOEURS (https://www.lessoeurs.be/en/service/returns/#online) must be strictly observed. In case of correct exercise of the right of withdrawal and provided that LES SOEURS has received the products with sufficient postage and within the stipulated period, the full purchase price (including the delivery costs paid by the buyer) of the purchased product will be refunded within 7 calendar days after the products have been returned. The refund will always be made by the same payment method used by the buyer to make his payment.
No refund can be claimed if the product has been used, if the packaging has been opened or damaged, the label removed or if it has not been returned in its original packaging. The right of withdrawal does not apply to personalised items made especially for the buyer. The buyer can use the official model form of the Belgian Government for this right of withdrawal.

Article 8 – Complaints and warranty
With regard to the delivery of goods, LES SOEURS applies the statutory minimum guarantee period of 2 years if the good does not conform to the order placed or is defective upon delivery. This means that in case of defects or faults in the good upon delivery, a free repair or replacement is possible up to 2 years after delivery. The warranty period is reduced to 1 year from delivery date for outlet models. This guarantee is limited to defects resulting from a production error or non-conformity upon delivery. Damage due to normal wear and tear, misuse, external influences or negligence of the buyer is not covered by the warranty. The purchaser has 3 days from the discovery of the defect (defects, damage, non-conforming order) to report it to LES SOEURS whereby, in addition to the order number and the name of the purchaser, the proof of purchase and a photo/video of the incorrect or damaged product must be able to be presented. As far as possible and feasible, the buyer will have the choice between repair or replacement. If neither is possible or cannot be carried out within a reasonable time, rescission of the sales agreement may be requested. Filing a complaint does not release the buyer from payment obligations.
A return must be freight-free and cost-free for LES SOEURS and will only be accepted if prior written or e-mail approval is given.

Any printing, typing or other errors or omissions in the seller's brochures, quotations, price lists, offers, invoices or other documents or information of the seller such as, for example, on the website, shall not bind the seller. Orders delivered damaged must be reported to LES SOEURS within 48 hours of delivery.
 
Article 9 – GDPR
The seller treats all personal data of former, current and potential customers confidentially and in accordance with applicable privacy laws. Customers can request, correct, change or delete their data at any time and are informed through the privacy statement which can be found at www.lessoeurs.be or requested from the seller.

Article 10 – Intellectual property rights
The contents of the website, including text, logos, images, graphics, data and software, are the exclusive property of LES SOEURS and are protected by all applicable laws. Photos and other images may not be reproduced, transferred or printed for commercial purposes.
 
Article 11 – Applicable law and competent court
These Terms of Sale and all agreements between the parties are governed exclusively by Belgian law. In the event of a dispute, the territorial jurisdiction of the courts shall be determined on the basis of the address of the seller's registered office, i.e. Hasselt.
